Rebel Wilson back in Australian courts in defamation appeal

Rebel Wilson has applied to Australia's highest court to increase the comic actress's payout from a defamation case against a magazine publisher.
The 38-year-old, best known for parts in the "Pitch Perfect" and "Bridesmaids" movies, was awarded in September an Australian record 4.6 million Australian dollars ($3.5 million) in damages.
A Victoria state Supreme Court jury found that that German publisher Bauer Media defamed her in a series of articles in 2015 claiming she lied about her age, the origin of her first name and her upbringing in Sydney.
But three judges on the Court of Appeal last month upheld an appeal by Bauer and slashed Wilson's payout to AU$600,000 ($454,000).
The appeal court ruled that the trial Judge John Dixon should not have compensated Wilson for film roles, including "Trolls" and "Kung Fu Panda 3," which she testified she had lost due to the damage the articles had done to her reputation.
She was also ordered to pay 80 percent of Bauer's legal costs in mounting its appeal.
Wilson lodged an application to the High Court late Wednesday to restore Dixon's ruling. The High Court registry made the court documents public on Thursday.
The Court of Appeal overturned Dixon's finding that Wilson's career had been on an "upward trajectory" before the articles, instead saying the judge had given "a picture of the plaintiff's career trajectory that significantly overstated its success and ignored its hiccups."
According to court documents, Wilson's lawyers will argue Dixon was correct, and that he was also correct in finding the articles caused a "huge international media firestorm" affecting Wilson's career and reputation.
The lawyer will also argue the Court of Appeal was wrong in concluding Wilson needed to prove economic loss by showing a project had been canceled. |

Attorneys in a negligence lawsuit stemming from the Las Vegas Strip shooting say the massacre could have been avoided if hotel management tightened security after a man was found with multiple weapons at the Mandalay Bay resort in 2014.
Lawyer Robert Eglet said Friday the arrest of Kye Aaron Dunbar in a 24th-floor Mandalay Bay room with guns including an assault-style rifle, a tripod and a telescopic sight bears similarities to the Oct. 1 shooting.
Last year, gunman Stephen Paddock killed 58 people shooting modified assault-style weapons from a 32nd-floor room at the Mandalay Bay into a concert crowd below.
Dunbar is 32 and serving federal prison time after pleading guilty to unlawful possession of a firearm by a felon.
Hotel officials aren't commenting about a court filing Thursday that brought the Dunbar case to light.

Police shooting of boy spurs more protests, appeals

Protesters demonstrated Friday for a third day over the fatal police shooting in Pennsylvania of an unarmed black teen fleeing a traffic stop as they sought to get the attention of a nation engrossed by the immigration debate, and to pressure officials to charge the officer.
Hundreds of marchers chanting "Who did this? The police did this" shut down a Pittsburgh area highway in the early morning hours, and a small group staged a sit-in outside the district attorney's office later in the day.
Demands for answers to why a police officer shot 17-year-old Antwon Rose Jr. seconds after he bolted from a car grew with an emotional speech by state Rep. Jake Wheatley at the state Capitol, and a videotaped appeal by the legislator and two other black Pittsburgh area lawmakers for a "thorough and transparent investigation that builds community."
"My heart is heavy right now," Wheatley said , decrying both Rose's death and the street violence that earlier in the week left a young rapper dead. "We cannot casually keep closing our eyes and ears to the fact there's a group of people whose lives seemingly don't matter."
Rose was shot Tuesday night in East Pittsburgh, a suburb of Pittsburgh, after the car he was riding in was pulled over by Officer Michael Rosfeld because it matched the description of a car wanted in a shooting in a nearby town, police said. The car had bullet damage to a back window.
As Rosfeld was taking the driver into custody, a video taken from a nearby house shows Rose and a second passenger running from the car. Three gunshots can be heard, and the passengers can be seen either falling or crouching as they pass between houses. It is unclear from the video if Rosfeld yelled for them to stop.

Egypt refers 28 to criminal court for forming illegal group

Egypt's chief prosecutor has referred 28 people to a criminal court on charges including forming an illegal group aiming to topple the government.
Sunday's statement by prosecutor Nabil Sadek says the suspects face an array of additional charges, including inciting violence and disseminating false news.
The statement says the suspects formed an illegal group, "The Egyptian Council for Change," to incite against the state and its institutions.
It says only nine of the 28 suspects are in custody. No date has been set for the trial. Egypt has intensified a long-running crackdown on dissent since President Abdel-Fattah el-Sissi's re-election in March.
The arrests are part of a wider crackdown on dissent since the 2013 military ouster of an elected Islamist president following mass protests against his one-year divisive rule. |
