Wisconsin kidnapping suspect appears in court

The woman charged with kidnapping her 5-day-old nephew from Wisconsin and leaving him overnight in freezing temperatures outside an Iowa gas station said in federal court that she asked for a lawyer but wasn't granted one during FBI questioning.
Kristen Smith, 32, made her first statements Thursday since pleading not guilty to taking Kayden Powell from a Town of Beloit home where she was staying when she left in the middle of the night for her home in Aurora, Colorado, in February.
Hours later, Iowa police arrested Smith for an outstanding Texas warrant and took her to the county jail for processing. While there, FBI agents questioned her about the missing newborn and conducted a polygraph test. Attorneys disagreed Thursday about whether interviews with police and the FBI should be used in an eventual trial.
Defense attorney Matt Noel said none of Smith's interviews the first day with FBI agent James McMillan should be allowed in the courtroom because the FBI didn't read Smith her rights. Noel also said Smith was coerced into providing incriminating evidence without an attorney, and that Smith was forced into taking the polygraph test, which agents say showed Smith was being deceitful.
Assistant U.S. Attorney Julie Pfluger said officers read Smith her rights before her arrest and later during questioning and the polygraph test. She also showed video clips of McMillan interviewing Smith.
The clips showed that Smith was upbeat and cooperative early on, and that she permitted agents to search her car and phone. McMillan told Smith her behavior was suspicious after she gave a wrong password to unlock the phone. |

California court charging for online access

A Northern California county has begun charging people to look at civil court records online — part of a trend at cash-strapped courthouses around the state that is raising concerns among some lawyers and public access groups, a newspaper reported.
As of April 23, Alameda County Superior Court charges $1 for each of the first five pages of a civil court record downloaded online, the Oakland Tribune reported on Monday.
The per-page viewing cost drops to 50 cents after the fifth page, and there is a $40 maximum charge for any single document.
Sacramento County Superior Court is implementing a similar fee structure this summer, the Tribune reported. Fees in the Los Angeles County Superior Court system start at $4.75 for each record search. Santa Clara County plans to begin charging in two to four years, according to the Tribune.
Court officials say the fees help make up for cuts in state aid.
"There's a budget crisis in the courts," said Teresa Ruano, spokeswoman for the state's Administrative Office of the Courts. "Revenue is part of the solution, a small part of the solution."
Each court decides whether it wants to charge a fee for records, though the state sets the maximum amount that can be charged for both paper and online records. Some counties don't put records online, forcing people to come in and visit the clerk's office. |

Bankrupt Stockton defends financial plan in court

The largest city in California to file for bankruptcy protection is asking a judge Monday to approve its plan for reorganizing more than $900 million in long-term debt to rescue the city from two years of financial uncertainty.
Standing in Stockton's way is Franklin Templeton Investments, which says the city is treating it unfairly. In 2009, Templeton loaned Stockton $35 million to build firehouses, parks and move its police dispatch center. Franklin says the city today is offering it $350,000.
The city has reached deals with all of its major creditors, except for Franklin, which is taking Stockton to a trial before U.S. Bankruptcy Judge Christopher Klein.
Stockton's bankruptcy attorney Marc Levinson recently told the City Council that he knows Franklin isn't happy. "We are choosing our battles and fighting where we have to fight and making deals where we can," Levinson said.
An inland port city 80 miles east of San Francisco, Stockton filed for Chapter 9 protection in 2012, making it the nation's largest bankrupt city before Detroit filed for bankruptcy last year. Vallejo went through bankruptcy before Stockton. San Bernardino filed shortly after Stockton, but it has yet to present an exit plan. |

New Hampshire court upholds COPSLIE vanity plate

If a New Hampshire man thinks cops lie, he's free to say so on his license plate, the state's highest court ruled Wednesday.
In a unanimous decision, the state Supreme Court agreed with the arguments of David Montenegro, who wanted the vanity plate reading "COPSLIE" to protest what he calls government corruption.
State law prohibits vanity plates that "a reasonable person would find offensive to good taste." But the New Hampshire Civil Liberties Union argued that the law is unconstitutionally vague and gives too much discretion to a person behind a Department of Motor Vehicles counter.
New Hampshire had argued that state workers were right to deny the plate, because the phrase disparages an entire class of people — police officers.
The justices said that state law does not define the phrase "offensive to good taste."
"The restriction grants DMV officials the power to deny a proposed vanity registration plate because it offends particular officials' subjective idea of what is 'good taste,'" the court wrote. The decision states the law is unconstitutionally vague and violates free speech rights.
The case was sent back to Strafford County Superior Court for further proceedings.
Attorney Anthony Galdieri, who argued the case on behalf of Montenegro and the New Hampshire Civil Liberties Union, said he was not surprised by the ruling. "This regulation was an impermissible way to regulate speech under the First Amendment," Galdieri said. |
